Promotion at ClueCheck's sole discretion.
1. Eligibility & Strict Limits
- Applies only after client completes one full paid evaluation project (100% payment received).
- Claim must be submitted in writing within 30 days of final report delivery to contact@cluecheck.co.uk. Late claims rejected.
- Maximum one free evaluation per client, ever. No stacking or repeats without new paid project.
- Limited to first 25 clients engaging under this promotion. Promotion automatically ends once 25 clients activated.
- Clients must be first-time users of ClueCheck (no prior projects).
2. Guarantee Trigger – Dual Proof Required
Free next evaluation (ClueCheck service fee ONLY waived; client pays 100% shopper reimbursements + expenses) if BOTH conditions proven:
- No material errors in original report (ClueCheck verifies accuracy/completeness within 7 days).
- Client implemented ≥50% actionable recommendations with physical evidence:
- Dated photographs of changes
- Staff training records/logs
- Process change receipts or documentation
- Third-party verification (manager confirmation)
Self-declaration or verbal confirmation is insufficient.
3. Objective Success Metrics (ClueCheck-Controlled)
Success is determined by ClueCheck's assessment of:
- Report accuracy ≥95% (shopper compliance, data integrity, factual correctness)
- Actionable recommendations provided (minimum 5 per report)
- Client CX/outcomes excluded – external factors (staff turnover, market changes, client delays, seasonal variations) are NOT covered by this guarantee
This guarantee covers ClueCheck's service quality and report delivery, NOT factors beyond ClueCheck's control.
4. Repeat/Unhappiness Claims
- Client must pay all shopper costs upfront for any repeat evaluation (separate invoice issued).
- "Unhappiness" requires specific, evidence-based reasons versus report findings. Generic complaints (e.g., "I didn't like the tone") are not eligible.
- ClueCheck's good-faith decision is final. No appeals process; disputes resolved via good-faith negotiation (Section 6).
- No free repeats without new paid project first (at full rate).
5. Exclusions (No Exceptions)
The guarantee does NOT apply if:
- Client non-implementation or incomplete implementation (<50% recommendations acted upon)
- Client delays >7 days in responding to recommendations or providing evidence
- External factors beyond ClueCheck's control (staff turnover, market conditions, regulatory changes, client business changes)
- Incomplete projects, unpaid invoices, or invoices overdue >14 days
- Bad faith claims (i.e., client requests free evaluation without genuine implementation attempt)
- Subjective dissatisfaction without evidence automatically rejected
6. Claim Process (Mandatory)
Step 1: Email Claim (within 30 days of report delivery)
- Email to contact@cluecheck.co.uk
- Include: Invoice/order number, project completion date, brief description of implemented recommendations (≥50%)
- Attach: Supporting evidence (photos, logs, training records, manager confirmation)
- Include: Measurement results or evidence showing 50%+ implementation
Step 2: ClueCheck Review (max 7 business days)
ClueCheck verifies:
- Report was delivered on time and contains no material errors
- Client provided sufficient implementation evidence (≥50% of recommendations)
- Measurement methodology is objective and fair
- Client meets all eligibility requirements
ClueCheck notifies client of approval or decline in writing with full explanation
Step 3: Approved Claims
- ClueCheck issues invoice for shopper reimbursements ONLY (service fees waived)
- Invoice due within 7 days
- Free evaluation must be scheduled and completed within 14 days of claim approval
- Evaluation follows same scope/methodology as original project
Step 4: Declined Claims
- ClueCheck provides written explanation with specific reasons
- Client may request one-time good-faith review within 14 days
- Final decision made after review (14-day period)
7. Dispute Resolution
If client disagrees with ClueCheck's decision:
1. Good-Faith Negotiation (14 days)
- Email contact@cluecheck.co.uk with written explanation and additional evidence
- ClueCheck responds within 7 business days
2. Final Decision
- After 14-day negotiation window, ClueCheck's decision is final and binding
- No further appeals or escalation accepted
3. Escalation (only if required by law)
- Consumer Rights Centre (general consumer issues)
- Local Trading Standards office
- Relevant ombudsman (if applicable to client's industry)
8. Free Evaluation Scope and Costs
What is Covered (Free):
- ClueCheck service fees for report compilation and analysis
- All professional evaluation and recommendations
- Same project scope as original evaluation
What is NOT Covered (Client Pays):
- Shopper reimbursement fees (at standard rates per assignment)
- Travel/accommodation costs incurred by shoppers
- Ancillary services or bespoke reporting (if requested)
- Any variations to original project scope
9. Repeat Project Request (If Unhappy)
If client requests a repeat evaluation (regardless of satisfaction):
- Client must pay in full for repeat (both ClueCheck service fees AND shopper reimbursement)
- The 100% Risk-Free Guarantee does NOT automatically apply to repeat projects
- ClueCheck will assess viability and provide separate quotation
- No guarantee applies to repeat projects unless explicitly agreed in writing
This prevents abuse of the promotion while ensuring fairness.
10. Good Faith and Discretion
- ClueCheck operates this guarantee in good faith and expects clients to act similarly
- Subjective complaints (e.g., "I didn't like the tone" or "Expected different insights") are NOT grounds for claiming the free evaluation
- ClueCheck retains final discretion to approve or decline claims where borderline circumstances arise
- All decisions documented in writing and provided to client with detailed explanation
- ClueCheck may decline any claim deemed to be in bad faith or an attempt to abuse the promotion
11. Limitation of Liability
ClueCheck is NOT liable for:
- Measurable improvements that fail due to factors outside the scope of evaluation findings (external market conditions, staffing issues unrelated to report, regulatory changes)
- Failure to achieve client expectations if expectations were not clearly defined before project commenced
- Client decisions to not implement recommendations or implement them incompletely
- Results of client implementation (quality/execution of recommendations is client's responsibility)
12. Consumer Rights (Statutory Protection)
This guarantee is IN ADDITION TO (not instead of) your statutory rights under the Consumer Rights Act 2015:
- Right to receive services with reasonable skill and care
- Right to receive services within a reasonable timeframe
- Right to fair and transparent pricing
- Right to access dispute resolution if needed
This guarantee does not exclude or limit statutory rights; it enhances protection.
13. Promotion Duration and Variation
- Promotion valid: 1 January 2026 – 30 June 2026
- Automatic end: When 25 first-time clients have engaged under this promotion (whichever comes first)
- Changes to terms: ClueCheck may vary terms only with 30 days' written notice; changes will NOT apply retroactively to clients already engaged
- Promotions withdrawn: May be terminated at any time by ClueCheck for abuse or systematic misuse; 7 days' notice to existing clients
14. Privacy and Data Protection
Your claim details (name, email, invoice number, evidence) will be processed in accordance with:
- UK GDPR
- ClueCheck Privacy Policy (www.cluecheck.co.uk/privacy)
Evidence provided will be retained for 12 months for audit, record-keeping, and legal compliance purposes.
15. Complaints and Disputes
If unhappy with a claim decision:
- Written complaint to contact@cluecheck.co.uk within 14 days of decision, including:
- Original claim details
- Reason for disagreement
- Any additional evidence
- ClueCheck response within 10 business days with final decision and explanation
- If unresolved, escalate to:
- UK Consumer Rights Centre
- Local Trading Standards office
- Relevant ombudsman service
16. Governing Law and Jurisdiction
These Terms and Conditions are governed by English law and subject to the jurisdiction of the courts of England and Wales.
Both parties agree to:
- Attempt amicable resolution via good-faith negotiation before pursuing legal action
- Accept ClueCheck's final decisions on claim eligibility and interpretation
